Heard the parties.

The petitioners claim that their land was acquired under the Coal Bearing Area (Acquisition and Development) Act, 1957 some time in the year 1990 but they have not received any amount.

To counter this, the learned counsel for the Central Coalfields Limited (CCL), based on record, submits that a cheque was issued to the petitioner Vijoy Oraon @ Bijoy Oraon way back in the year 2001 vide cheque No. 348858 dated 17.1.2001 drawn in favour of Punjab National Bank, Bachhra Branch (Jharkhand) and the said amount has been credited. He further submits that the Ledger of the CCL shows that the cheque has been received by the petitioner.

Learned counsel for the Bank submits that the transaction is of the year 2001 and this petition has been filed in the year 2021 and there are no records available with the Bank and the same could not be retrieved after twenty years.

Admittedly, the land was acquired in the year 1990 and as per ledger of the CCL, the cheque has been received by the petitioner. After twenty years the petitioners have come before this Court taking a plea that the amount has not been paid to them.

It is not expected that the Bank and CCL will keep the records of the same for more than twenty years. If at all the petitioners were not paid money, they should have approached immediately, which the petitioners have failed to do. Thus, no specific finding can be given in this case that the petitioner has not received the amount.

In view of the aforesaid fact, no relief, as sought for by the petitioners, can be granted in this writ petition. Accordingly, the same is dismissed . Pending interlocutory applications, if any, also stand disposed of.
