3. The appeal has been filed against the impugned order dated 31.07.2025 in A.B.P. No.940of 2025 passed by the learned Additional Sessions Judge-1^st , Chatra in connection with Lawalong P.S. Case No.43 of 2023, registered for the offence under Sections 147, 323, 427, 379, 386, 504 and 506 of the Indian Penal Code, under Section 3(1)(x) of the SC/ST (PoA) Act and under Sections 27 of the Arms Act. The case is presently pending in the court of the learned Additional Sessions Judge-1^st -cum-Special Judge, SC & ST Act, Chatra.

4. Although Section 18 of the SC/ST (PoA) Act bars the grant of anticipatory bail, such embargo would not apply where no prima facie offence under the provisions of the Act is made out.

It has been submitted by the learned counsel for the appellants that there is land dispute exists between the parties and for that purpose original civil suit has been filed numbered as Original Civil Suit No.85 of 2023 before the learned civil Judge (Jr. Div.1), Chatra against the informant. The opposite parties are not participating in the said civil suit rather as a counter blast the present criminal case has been lodged on 22.02.2023. It is further submitted that a civil dispute has been maliciously given a criminal colour and the entire family members have been implicated as accused in this case. The appellants undertake to participate in the trial. On the above basis, the prayer for anticipatory bail has been made.

6. On the other hand, learned counsel for the State and Respondent No.2 have opposed the prayer for anticipatory bail. It is submitted by them that the land, in question, is in possession of the respondent/informant and his possession has been tried to be disturbed and assault was committed and abusive language was used by the appellants.

7. Having heard the learned counsel for the parties and from perusal of the records, it appears that there is serious land dispute between the parties and a civil suit is also pending.

Considering the above facts, the appellants, above named, are directed to surrender in the court below within four weeks from the date of receipt/ production of the copy of this order and in the event of their arrest or surrender, they shall be enlarged on bail, on their furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-1^st -cum-Special Judge, SC & ST Act, Chatra in connection with Lawalong P.S. Case No.43 of 2023 on the conditions as laid down under Section 482 B.N.S.S., 2023 . Further, the appellants will submit self-attested photocopy of their Aadhaar Cards and also submit their mobile number before the learned court below which they will always keep active and will not change it during pendency of this case without prior permission of the court.

9. In the result, the instant appeal stands allowed and disposed of.
