1. Heard the parties.
2. The present criminal appeal has been filed against the impugned order dated 23.09.2024 passed in M.C.A No.426 of 2024 by the learned Additional Sessions Judge-1-cum-Special Judge, SC/ST, Dumka in connection with Shikaripara P.S. Case No.33 of 2024, corresponding to SC/ST P.S. Case No.15 of 2024, registered for the offence under Sections 376(2)(n) & 384 of the Indian Penal Code & Sections 3(1)(W)(ii) of the SC/ST (PoA) Act, whereby and whereunder the prayer for bail of the appellant was rejected. Now, the case is pending in the court of the learned Additional Sessions Judge-1-cum-Special Judge, SC/ST, Dumka.
3. After some arguments, learned counsel for the appellant seeks permission to withdraw the present criminal appeal with a liberty to file fresh one with better particulars after moving the Original Court.
4. Learned counsel for the State has raised no objection.
5. Permission is granted. Accordingly, the present criminal appeal is hereby, dismissed as withdrawn.
6. Pending I.A., if any, also stands disposed of.
