Heard learned counsel for the appellant, learned APP for the State and learned Amicus Curiae for the victim.

The present appeal has been filed against the order dated 13.05.2026 passed by learned Additional Sessions Judge-I, Latehar in Children Case No.04 of 2026 arising out of Latehar P.S. Case No.39 of 2025, registered for the offence under Sections 65(1) of the BNS, 2023 and Section 4 of the POCSO Act by which prayer for bail of the appellant has been rejected. The case is pending before the Court of learned Additional Sessions Judge-I, Latehar.

The juvenile in conflict with law, who is in custody since 15.02.2025, has approached this Court for release through his mother who is ready and willing to keep her child under her custody with proper care. It appears that the juvenile is accused of committing rape. The charge has been framed on 11.05.2026 by the trial Court under Section 65(1) of BNS and under Section 4/6 of the POCSO Act.

On the other hand, learned counsel for the State has opposed the prayer of the appellant.

Considering the social investigation report, the appellant is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Latehar in connection with Latehar P.S. Case No.39 of 2025, (Children Case No. 04 of 2026) subject to the

condition that one of the bailors must be the mother of the appellant.

Further, concerned Probation Officer is directed to report, once in three months, to the Children's Court, Latehar regarding the conduct of the juvenile. The Children’s Court is at liberty to take the juvenile in custody if his conduct is not found appropriate.

Let this order be communicated to the learned Member Secretary, JHALSA, Ranchi, for the purpose of remuneration to be paid to the learned Amicus Curiae as permissible.

Accordingly, instant criminal appeal is allowed and disposed of.
