Heard the learned counsel for the respective sides.

This application is directed against the judgment dated 27.07.2026, passed by the learned Special Judge, Children Court, Dhanbad in Criminal Appeal No. 162 of 2026, whereby and whereunder, the order dated 05.06.2026, passed by the learned Principal Magistrate, Juvenile Justice Board, Dhanbad in connection with Nirsa P.S. Case No. 98 of 2026 rejecting the prayer for bail of the petitioner has been affirmed.

It has been alleged that the son of the informant was murdered by the named accused persons and some unknown persons.

Submission has been advanced by the learned counsel for the petitioner that the petitioner is not named in the First Information Report and he has been implicated subsequently on suspicion. It has been submitted that one Prem Bouri has been granted bail in Criminal Revision No. 876 of 2026. Learned counsel further adds that the allegations are general and omnibus in nature and the social investigation report is not adverse to the cause of the petitioner. It has been submitted that the petitioner is in observation home since 27.04.2026.

Learned A.P.P. has opposed the prayer for bail made by the petitioner.

It seems that in similar circumstances one of the co-accused has been granted bail in Criminal Revision No. 876 of 2026. There is no direct

allegation against the petitioner and the said allegation seems to be general and omnibus in nature and the name of the petitioner has transpired subsequently as he has not been named in the First Information Report. So far as the social investigation report is concerned, it appears that the behaviour of the petitioner has been opined to be normal and the incident had occurred on account of the dispute between the petitioner and the son of the informant as assessed by the Probation Officer.

Regard being had to the aforesaid facts, the order dated 05.06.2026, passed by the learned Principal Magistrate, Juvenile Justice Board, Dhanbad in connection with Nirsa P.S. Case No. 98 of 2026 and the judgment dated 27.07.2026, passed by the learned Special Judge, Children Court, Dhanbad in Criminal Appeal No. 162 of 2026 are hereby quashed and set aside with a direction to release the petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Dhanbad in connection with Nirsa P.S. Case No. 98 of 2026, subject to the conditions that the father of the petitioner shall ensure the safe keep of the petitioner and shall further ensure that the petitioner does not mingle with anti-social elements.
