This application is directed against the judgment dated 03.04.2024 passed by the learned Additional Sessions Judge-IV, Jamshedpur in Criminal Appeal No. 122 of 2023, whereby and whereunder, the judgment and order of conviction and sentence dated 29.05.2023 passed by the learned Additional Chief Judicial Magistrate, Jamshedpur in Complaint Case No. 3249 of 2016, convicting the petitioner for the offence punishable u/s 420 I.P.C. and sentencing him to undergo S.I. for two years and to pay a fine of Rs. 10,000/-, has been affirmed.

It has been submitted by Mr. A.K. Kashyap, learned senior counsel for the petitioner that during the pendency of this revision application, the matter has been compromised between the parties for which he has referred to I.A. No. 13196 of 2024 which has been filed by way of joint compromise by the petitioner and the opposite party No. 2. Learned senior counsel submits that in terms of the compromise an amount of Rs. 15 Lakhs has been paid by the petitioner to the opposite party No. 2 through demand draft dated 03.12.2024. Learned senior counsel therefore submits that in view of the compromise, this revision application be disposed of.

Mr. Pritam Mandal, learned counsel appearing for the opposite party No. 2 has accepted the factum of compromise as well the receiving of an amount of Rs. 15 Lakhs from the petitioner by way of demand draft and has stated that he does not have any objection if the prayer of the petitioner is allowed.

Regard being had to the fact that the offence in question is compoundable in nature and the matter has been compromised between both the sides, subsequent to which an amount of Rs. 15 Lakhs as agreed upon has already been extended by the petitioner to the opposite party No. 2, the judgment dated 03.04.2024 passed by the learned Additional Sessions JudgeIV, Jamshedpur in Criminal Appeal No. 122 of 2023 and the judgment and order of conviction and sentence dated 29.05.2023 passed by the learned Additional Chief Judicial Magistrate, Jamshedpur in Complaint Case No. 3249 of 2016, are hereby set aside.

This criminal revision application stands disposed of and the pending I.A., if any, also stands closed.
