Heard Mr. Suraj Kishore Prasad, learned counsel for the petitioner and learned A.P.P for the State.

This application is directed against the order dated 06.12.2025 passed in Cr. Appeal (Bail) No. 40 of 2025 by the learned Additional Sessions Judge-1-cum-Special Judge (Children Court), Seraikella, whereby and whereunder, the order dated 01.11.2025 passed by the learned Principal Magistrate, Juvenile Justice Board, Seraikella in connection with MCRA No.1552 of 2025, arising out of Rajnagar P.S. Case No.76 of 2025, rejecting the prayer for bail of the petitioner has been affirmed.

Submission has been advanced by the learned counsel for the petitioner that the petitioner is in custody since 16.09.2025. It has further been stated that admittedly, there was love affair between the victim and the petitioner, as a result of which, both had eloped and had gone to Howrah.

Learned A.P.P has opposed the prayer for bail of the petitioner.

The allegation reveals that the petitioner had enticed away the daughter of the informant as would appear from the impugned order dated 06.12.2025. The statement of the victim was recorded under Section 183 BNSS, in which, she has stated that both had stayed in a hotel at Howrah and physical relationship was also established between them. The statement of the victim recorded under Section 183 BNSS does signify that there was a love affair between the petitioner and the victim.

On consideration of the said facts, while setting aside the order dated 06.12.2025 passed in Cr. Appeal (Bail) No. 40 of 2025 by the learned Additional Session Judge-1-cum-Special Judge (Children Court), Seraikella, and the order dated 01.11.2025 passed by the learned Principal Magistrate, Juvenile Justice Board, Seraikella in MCRA No.1552 of 2025, arising out of Rajnagar P.S. Case No.76 of 2025, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Seraikella, in connection with Rajnagar P.S. Case No.76 of 2025, subject to the condition that the father of the petitioner shall ensure the safety of the petitioner and shall further ensure that the petitioner is kept away from anti-social elements.

This application is allowed.
