This appeal is directed against the order dated 20.02.2026 passed in Misc. Criminal Application No. 368 of 2026, arising out of Haidarnagar P.S. Case No. 52 of 2024, by the learned Additional Sessions Judge-IX, Palamau at Daltonganj, whereby and whereunder the prayer for bail of the appellant has been rejected.

It has been alleged that some extremists had come to the site of M/s. Abhay Enterprises and had set ablaze JCB vehicles as well as tractors.

Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated only on the basis of suspicion. It has further been submitted that the appellant is in custody since 19.09.2024. Learned counsel submits that one of the co-accused Rajendra Singh @ Rajendra Jee has been granted bail by this Court in Cr. A. (DB) No. 969 of 2025.

Learned A.P.P. has opposed the prayer for bail of the appellant.

Regard being had to the manner of implication of the appellant and the fact that he is in custody since long, we while setting aside the order dated 20.02.2026 passed in Misc. Criminal Application No. 368 of 2026, arising out of Haidarnagar P.S. Case No. 52 of 2024, by the learned Additional Sessions Judge-IX, Palamau at Daltonganj, direct the appellant be released on bail on furnishing bail bond of Rs.10,000/(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IX, Palamau at Daltonganj.

Accordingly, this appeal is allowed.
