Heard the learned counsel for the respective parties.

This appeal is directed against the order dated 08.01.2026 passed in B.P. No. 9/2026 by the learned Additional Sessions Judge-I-cum-Special Judge, Gumla, arising out of Raidih PS Case No. 63/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.

The allegation reveals about selling of a new born child. The appellant has been implicated on account of having facilitated the said transaction.

It has been submitted by the learned counsel for the appellant that the appellant is in custody since 09.12.2025 and one of the co-accused similarly situated, namely, Parwati Devi has been granted bail by a co-ordinate Bench of this Court in Criminal Appeal (DB) No. 97 of 2026.

Learned A.P.P. has opposed the prayer for bail of the appellant.

Regard being had to the aforesaid facts, we while setting aside the order dated 08.01.2026 passed in B.P. No. 9/2026 by the learned Additional Sessions Judge-I-cum-Special Judge, Gumla, arising out of Raidih PS Case No. 63/2025 direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Gumla in connection with Raidih PS Case No. 63/2025.

This appeal is allowed.
