This appeal is directed against the order dated 24.07.2026 passed by the learned Additional Sessions Judge-I, Khunti in Misc. Criminal Application No. 244/2026 in connection with Arki P.S. Case No. 18/2010, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It appears that the appellant was granted bail by the learned trial court in B.P. No. 1622/2011 but from 01.05.2013, the appellant had left attending the case as a result of which bail bond was cancelled and ultimately on 29.04.2026, the appellant was apprehended by the Police and remanded in judicial custody. It appears that though charge has been framed but not a single witness has been examined. The prosecution has to examine 18 witnesses in this case.

Regard being had to the fact that the petitioner is in custody for more than 4 months, we while setting aside the order dated 24.07.2026 passed by the learned Additional Sessions Judge-I, Khunti in Misc. Criminal Application No. 244/2026 in connection with Arki P.S. Case No. 18/2010,

direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Khunti in connection with Arki P.S. Case No. 18/2010, subject to the condition that the appellant shall remain physically present before the learned trial court on each and every date till the conclusion of trial.
