This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 482 of the Code of Criminal Procedure, 1973 with the prayer to quash the entire criminal proceedings including the order dated 11.09.2024 passed by the learned Chief Judicial Magistrate, Seraikella whereby and where under the learned Magistrate has found prima facie case for the offences punishable under Section 406, 420/34 of the Indian Penal Code in connection with Adityapur P.S. Case No.127 of 2023 corresponding to G.R. Case No.447 of 2024.

The undisputed fact remains that the trial has proceeded substantially and so far four prosecution witnesses have been examined.

Keeping in view the substantial progress made in the trial and as this Court is not empowered to appreciate the evidence which has been put forth by the prosecution in the trial court by way of examination of the witnesses, in exercise of the power of this Court under Section 482 of the Code of Criminal Procedure, 1973, this Court is not inclined to accede to the prayer of the petitioner to quash the entire criminal proceeding at the fag end of the trial and leave it open for the trial court to take a call on the grounds taken by the petitioner in this Cr.M.P.

Accordingly, this Cr.M.P.. is disposed of with a direction to the learned trial court to consider the grounds taken by the petitioner in
