06/15.09.2026 Heard Mr. A.K. Sahani, learned counsel for the petitioners and learned Spl.P.P. for the State.

In this Petition, the petitioners have prayed for quashing the order dated 29.04.2026 passed by the learned Chief Judicial Magistrate, Gumla, in AHTU P.S. Case No. 01 of 2024, whereby and whereunder the process under Section 82 Cr.P.C. has been issued.

It has been submitted by the learned counsel for the petitioners that the impugned order dated 29.04.2026 does not contain any reasons and the same is cryptic and, therefore, is liable to be set aside.

Learned Spl.P.P. has opposed the prayer made in this petition.

It appears on a perusal of the order dated 29.04.2026 that the same does not contain any subjective satisfaction and is merely a reiteration of the application preferred by the Investigating Officer for issuance of process under Section 82 Cr.P.C.

In view of the above, therefore, the impugned order dated 29.04.2026 passed by the learned CJM,

Gumla, in connection with AHTU Gumla P.S. Case No. 01/2024 is hereby quashed and set aside.

This petition is allowed and disposed of accordingly.
