Heard the parties.
This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 528 of the B.N.S.S., 2023 with the prayer to modify the part of the order dated 27.01.2026 passed in B.A. No. 9654 of 2025 by a Co-ordinate Bench of this Court wherein the petitioner was directed to be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each.
Learned counsel for the petitioner submits that the petitioner is unable to furnish the bail bond and has been languishing in prison despite the bail has been granted to him. It is next submitted that vide order dated 03.07.2026 passed in this case, the petitioner was directed to file a supplementary affidavit mentioning therein the details with the names, age and address of the members of the family members of the petitioner and the list of all the movable and immovable property he is possessing either individually or jointly with others. In response to the same, supplementary affidavit has been filed and it is mentioned therein that the father, mother, brother, wife of the petitioner, all are alive and well to do persons; one of his brother
owns a bike, another brother owns a mobile phone and his father is having five Bigha of land. It is lastly submitted that the prayer as prayed for in this Criminal Miscellaneous Petition be allowed.
In view of the fact that the petitioner is facing the trial in connection with the case for having committed the offence punishable under Section 302 of the Indian Penal Code, and have well to do near relatives, this Court is not inclined to modify the order dated 27.01.2026 passed in B.A. No. 9654 of 2025
Accordingly, this Criminal Miscellaneous Petition, being without any merit, is dismissed.
