2. The instant application has been preferred by the petitioner for modification of the order dated 25.07.2023, passed in Cr. Appeal (S.J.) No.1532 of 2004, whereby the petitioner was sentenced to undergo for the period already undergone subject to payment of Rs.20,000/- each within a period of four months from the date of receipt of a copy of this order, before the learned Secretary, DLSA, Koderma.

Learned counsel for the petitioners submits due to lack of communication, the aforesaid amount could not be deposited within the stipulated period, although the petitioners are ready to deposit the same. Learned counsel further submits that in the interest of justice the time for depositing the fine amount before learned Secretary, DLSA, Koderma be extended and the order dated 25.07.2023 be modified to the extent that the fine amount of Rs.20,000/each may be directed to be deposited within a further period of Six weeks from today.

He lastly submits that out of six appellants two (2) appellants namely, Abbu Mian (appellant no.4) and Munna Mian (appellant no.6) died and as such their case have been abated.

Learned APP submits that though he does not oppose Six weeks time to the petitioners for depositing the fine amount, but if the petitioners fails to deposit the aforesaid amount of Rs.20,000/- each within Six weeks, their bail granted by this Court should be cancelled and they would serve rest of the sentence.

5. Having heard learned counsel for the parties and after perusing the order dated 25.07.2023, passed in Cr. Appeal (S.J.) No.1532 of 2004, I hereby modify the last portion of the order dated 25.07.2023 to the extent that the alive petitioners (petitioners herein) are directed to deposit fine amount of Rs.20,000/- each within a period of Six weeks from today before the learned Secretary, DLSA, Koderma.

6. It is made clear that if the aforesaid amount will not be deposited within the aforesaid period, the bail bond of these petitioners shall be cancelled and the petitioners would serve rest of the sentence.

7. With the aforesaid modification, the instant Cr.M.P is hereby allowed.

8. Let a copy of this order be communicated to the concerned court through “FAX”.
