Learned counsel for the petitioners submits that this interlocutory application has been filed with the prayer to amend the Cr.M.P. No. 1142 of 2025 by incorporating the additional prayer to quash the order dated 21.07.2026, passed by the learned Judicial Magistrate 1^st Class –XXI, Ranchi in connection with G.R. Case No. 1785 of 2025 arising out of Bariatu P.S. Case No. 302 of 2024 whereby and where under the learned Judicial Magistrate 1^st Class –XXI, Ranchi has rejected the discharge application filed by the petitioner under Section 262 of the BNSS in para-1 and prayer portion of the Cr.M.P. It is further submitted that the petitioner intends to incorporate para-6 to para-20 of this interlocutory application after para-34 and number them as para -35 to 49 and further to re-number para-35 to 37 of the first amended Cr.M.P. as para -50 to 52 respectively. It is next submitted that the proposed amendment was

necessitated because of the developments which took place after filing of this criminal miscellaneous petition. It is then submitted that the proposed amendment by incorporating the additional prayer will not change the nature and character of the instant criminal miscellaneous petition. It is lastly submitted that unless the proposed amendment is allowed, the petitioners will be highly prejudiced.

The learned Addl. P.P. and the learned counsel for the opposite party no.2 have no objection to the aforesaid prayer.

Considering the aforesaid facts, the prayer for amendment made in this interlocutory application is allowed.

The learned counsel for the petitioners files the consolidated criminal miscellaneous petition. Keep the same in the record. This interlocutory application is disposed of accordingly.
