The instant contempt application has been filed against the opposite parties for alleged willful and deliberate non-compliance of the order dated 30.01.2025 passed in L.P.A No.73 of 2024.

It has been submitted by the learned counsel for the writ petitioner/appellant that vide order dated 30.01.2025, which is the subject matter of the present contempt case, the direction was passed to reinstate the petitioner/appellant in service with all consequential benefits including full salary and allowances from the date of compulsory retirement. However, the respondent authorities, have also been granted liberty to initiate a

departmental proceeding against the appellant in accordance with law, if so advised.

Learned counsel appearing for the opposite parties by referring to Paragraph-10 (a), (b), (c), (d) of the supplementary show cause has submitted that the petitioner has been reinstated in service as also the arrears of the salary and other dues have also been released.

Learned counsel for the petitioner has submitted that the benefit of upgradation under ACP/MACP scheme has not been granted.

The learned counsel for the concerned opposite parties has submitted that in view of the liberty granted by this Court vide order dated 30.01.2025, which is the subject matter of the instant contempt case, a departmental proceeding afresh has been initiated which ultimately culminated into the order of punishment passed by the State in exercise of power conferred under Rule 43(b) of the Jharkhand Pension Rule, by which 10% permanent deduction from the petitioner’s pension has been inflicted, i.e., Annexure-A of the Show cause.

He, therefore, has submitted that now the finding of guilt is there and as such, the benefit in pursuance to the upgradation in pay scale has not been paid rather he has submitted that the better course available to the petitioner is to challenge the order passed under Rule 43(b) of the Jharkhand Pension Rule.

Upon this, learned counsel appearing for the petitioner submitted that the contempt case may be disposed of with liberty to the petitioner to challenge the order dated 02.05.2026, which is appended as Annexure-A to the show cause before the appropriate forum.
