This bail application has been filed on behalf of Rajesh Harijan @ Rajesh Kumar Das who is in custody since 28.06.2025 in connection with Godda (M) Motiya OP P.S. Case No. 112 of 2025 for the offence registered under Sections 74,79, 108 and 352 of the BNS, 2023 pending in the Court of learned CJM, Godda, is pressed into motion.

On the statement of the deceased recorded in the hospital, FIR was lodged. As per the FIR, petitioner used to make improper sexual advances against her and also recorded some obscene video which was made viral. After she came to know about this, she consumed poison and died during the course of treatment.

It is submitted by the learned senior counsel on behalf of petitioner that there is no evidence with regard to the obscene video and consequently, FIR was not lodged under any of the provision of the IT Act. There is no allegation that petitioner ever committed penetrative sexual assault with the deceased. The FSL report negated the prosecution case of death by consuming pesticides. The cause of death could not be ascertained as per the post-mortem report and therefore, it was a case of suicide.

Learned A.P.P. for the State assisted by counsel on behalf of the informant vehemently opposed the prayer for bail.

Having considered the submissions advanced on behalf of both sides, the very suicide by consuming pesticides comes under cloud in view of the postmortem examination report read with FSL report.

Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
