The petitioner has been made accused in connection with Nawa Bajar P.S. Case No. 92 of 2024 corresponding to G.R. Case No. 326 of 2025, S.T. Case No. 126 of 2025 registered for the offences punishable under Sections 103(1), 238, 3(5) of the B.N.S., 2023.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons committed murder of Sushil Kumar and threw the dead body in a well to screen himself and the co-accused persons of the offence of murder. It is next submitted that the allegation against the petitioner is false. It is admitted that the petitioner along with the coaccused went to market which goes to show that the petitioner and the deceased were pulling on well, yet no motive has been attributed to the petitioner of having committed murder of Sushil Kumar. It is next submitted that in the post-mortem report, the cause of death was mentioned as asphyxia caused by ante-mortem drowning and except swelling on the left side of the forehead, no injury on the dead body of the deceased could be detected. It is further submitted that the deceased accidently falling inside the well under the influence of liquor cannot be ruled out. It is then submitted that petitioner has no criminal antecedents as mentioned in para14 of the instant bail application. It is further submitted that the petitioner

has been in custody since 22.12.2024 as mentioned in para-13 of the instant bail application. It is next submitted that the charge has been framed against the petitioner on 20.06.2026, but no witness has been examined as yet. It is lastly submitted that the petitioner undertakes to co-operate with the trial of the case and also undertakes not to annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be released on bail.

Learned counsel appearing for the State opposes the prayer for bail of the petitioner.

Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IX, Palamau in connection with Nawa Bajar P.S. Case No. 92 of 2024 corresponding to G.R. Case No. 326 of 2025, S.T. Case No. 126 of 2025 with the condition that he

will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
