Heard the parties.
The petitioner has been made accused in connection with Tarhasi P.S. Case No.98 of 2025 (S.T. Case No.131 of 2026) registered under Section 126(2), 115(2), 118(2), 109, 333, 352, 351(2), 103 and 3(5) of the B.N.S., 2023.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co-accused persons, has committed murder of Chandradeep Bhuiyan. It is submitted that the allegation against the petitioner is false. It is further submitted that there is a delay of two days in lodging the F.I.R. It is also submitted that the allegation against the petitioner is general and omnibus in nature. It is lastly submitted that the petitioner has been in custody since 01.11.2025. Hence it is submitted that the petitioner be released on bail.
Learned Spl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that since the deceased was undergoing treatment immediately after the assault so, the informant being busy in attending the deceased at hospital, could
not immediately inform the police and the same is a satisfactory explanation for delay caused in lodging the F.I.R. It is further submitted that there is direct and specific allegation against the petitioner that the petitioner along with the co-accused persons has committed the murder of the deceased by assaulting the deceased with a Gadasa and Lathi by assaulting on his head and in view of direct and serious nature allegation against the petitioner, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. It is, therefore, submitted that the petitioner ought not be released on bail at this stage.
Considering the serious nature of allegation against the petitioner of committing the murder of Chandradeep Bhuiyan as well as his chance of absconding and tampering with the evidence, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected at this stage.
