05 /16.09.2026 Heard the learned counsel appearing on behalf of the parties.
2. Learned counsel for the petitioner submits that the petitioner is in custody in connection with Mahila Thana Gumla P.S. Case No.07/2026, registered under Sections 69, 351 (2) and 352 of the Bharatiya Nyaya Sanhita, 2023, now pending in the court of learned Sub-Divisional Judicial Magistrate, Gumla.
3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. As per the F.I.R., the first incident happened in the year 2021. He submits that the child born out of the alleged relationship is not the child of the petitioner. The learned counsel submits that sample for DNA test has already been collected.
4. Learned counsel for the State has opposed the prayer for bail and submits that there is a direct allegation against the petitioner of committing rape upon the victim and that that ultimately the petitioner refused to marry and, in the meantime, the victim became pregnant.
5. After hearing the learned counsels for the parties and in view of

direct allegation against the petitioner, this Court is not inclined to enlarge the petitioner on bail at this stage.
6. Accordingly, this bail application is rejected.
