Heard the parties.

The petitioners have been made accused in connection with Belbadda P.S. Case No.16 of 2026 registered for the offences punishable under Sections 103(1) of the B.N.S., 2023.

Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners have committed murder of Pintu Tanti. It is further submitted that the allegation against the petitioners is false. It is next submitted that the petitioners are not named in the FIR and an automatic pistol, a live cartridge and a fired cartridge have been recovered from the possession of the petitioners. It is next submitted that the petitioners have been implicated in this case only on the basis of confessional statement of the petitioners. It is further submitted that the petitioners have been in custody since 30.04.2026 as mentioned in para-26 of the instant bail application. Charge-sheet has already been submitted in this case. It is also submitted that the co-accused, with similar allegations, has already been admitted to bail by this Court vide order dated 25.08.2026 passed in B.A. No.7990 of 2026. It is lastly submitted that the petitioners undertake to cooperate with the trial of the case and also undertakes not to annoy or disturb

the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioners be released on bail.

Learned counsel appearing for the State opposes the prayer for bail of the petitioners.

Considering the facts of this case, the above-named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Godda in connection with Belbadda P.S. Case No.16 of 2026 with the condition that they will cooperate with the trial of the case and furnish their mobile numbers and photocopy of the Aadhar Cards in the court below with an undertaking that they will not change his mobile number during the trial of the case and they will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
