Heard the parties.
The petitioners have been made accused in connection with S.T. Case No. 110 of 2026 arising out of Satgawan P.S. Case No. 44 of 2026 registered for the offence punishable under Sections 140(2), 3(5) of the B.N.S., 2023.
This is the second journey of the petitioners with the prayer for regular bail. Earlier the prayer for regular bail of the petitioners was dismissed as withdrawn vide order dated 10.08.2026 passed in B.A. No. 7473 of 2026.
Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners abducted the victim Bintu Kumar who is the brother of the informant and demanded ransom of Rs.2,00,000/-. It is next submitted that the allegation against the petitioners is false. It is then submitted that the petitioners have been named by the victim. It is further submitted that the
petitioners have been in custody since 01.06.2026 as mentioned in para-11 of the instant bail application. It is next submitted that the petitioners are having two criminal antecedents also as mentioned in para-13 of the instant bail application. It is lastly submitted that the petitioners are ready and willing to co-operate with the trial of the case. Hence, it is submitted that the petitioners be released on bail.
Learned counsel appearing for the State on the other hand opposes the prayer for bail of the petitioners and submits that keeping in view the direct allegation of serious nature against the petitioners of abducting the victim Bintu Kumar as well as their criminal antecedents, there is every chance of the petitioners absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioners ought not to be released on bail.
Considering the serious nature of allegation against the petitioners as well as their criminal antecedents and the chance of their absconding and tampering with the evidence, if released on bail, this Court is not inclined to admit the above named petitioners on bail.
Accordingly, the prayer for bail of the above named petitioners is rejected.
