Heard the parties.
The petitioner has moved before this Court for grant of bail in connection with Tamar P.S. Case No. 21 of 2026, registered for the offences punishable under sections 111(2), 111(3), 112(2), 318(4), 49, 61(2), 3(5) of the B.N.S., 2023 along with Section 12(3) of the Jharkhand Competitive Examination (Measures for Control & Prevention of Unfair Means in Recruitment), Act.
The learned Senior Advocate appearing for the petitioner submits that the allegation against the petitioner is that the petitioner is a member of a Gang responsible for leaking of question paper of Jharkhand Excise Constable Examination. It is next submitted that the allegation against the petitioner is false and the main allegation is against Chunchun Kumar who provided one set of question paper with answer by intimating the candidates, who wanted to appear by adopting unfair means; that the same has been obtained from the agency involved in conducting the examination. It is next submitted that the petitioner has been implicated in this case only because he was getting the candidates memorized the answers of the question paper prepared by coaccused- Chunchun Kumar. It is then submitted that though
charge sheet has been submitted in this case but no witness has been examined as yet. It is further submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no. 05 of the bail application. It is then submitted that the petitioner has been in custody since 12.04.2026, as has been mentioned in paragraph no. 01 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the co-accused person with similar allegation has already been admitted to bail by this Court vide order dated 08.07.2026 in B.A. No.6308 of 2026. Hence, it is submitted that the petitioner be admitted to bail.
The learned P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Judicial Commissioner – I, Ranchi in connection with Tamar P.S. Case No. 21 of 2026 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case.
