05 /15.09.2026 Heard the learned counsel appearing on behalf of the parties.
2. Learned counsel for the petitioner submits that the petitioner is in custody since 23.06.2026 in connection with Chandrapura P.S. Case No.72 of 2026, registered under Sections 126 (2)/115 (2)/64 (1) /351 (2) of BNS, 2023, now pending in the court of learned A.C.J.M, Bermo at Tenughat.
3. The learned counsel for the petitioner submits that the victim happens to be a Home Guard in the Jharkhand Armed Forces and the petitioner has been falsely implicated in this case. He submits that the petitioner and the victim were in love affair, and the petitioner climbed the tower only at the instance of the victim, who insisted that if the petitioner loves the victim, he should climb the tower. However, after climbing the tower, the petitioner is alleged to have raised loud voice taking her name. Consequently, in order to save her own skin, the victim has lodged this case.
4. The learned counsel for the State has vehemently opposed the prayer for bail and submitted that there is direct and specific

allegation of committing forceful rape and the petitioner has been threatening and troubling the victim, therefore, in such circumstances, the petitioner may not be enlarged on bail.
5. After hearing the learned counsel for the parties and considering the direct allegation made in the FIR itself against the petitioner by the victim, who is also informant of the case and victim is yet to be examined before the court , this Court is not inclined to enlarge the petitioner on bail at this stage.
