2. This Civil Misc. Petition has been preferred for restoration of writ petition being W.P.(C) No. 3976 of 2022, which was dismissed for non-compliance of the peremptory order dated 07.02.2024.

3. Earlier, this Court vide order dated 17.10.2025 in a Civil Misc. Petition being C.M.P. No.848 of 2025, allowed the said C.M.P. and restored the W.P.(C) No. 3976 of 2022, with a condition that if the defects are not removed, the order will not be given effect to.

4. Thereafter, the defects remained uncured and the said writ petition stood dismissed.

5. Learned counsel representing the petitioner begs an unconditional apology and submits that no sooner the writ petition is restored to its original file, he will remove the surviving defect.

6. Learned counsel representing the opposite parties do not oppose the aforesaid submission.

7. Considering the submission of learned counsel representing the petitioner, this Civil Misc. Petition is allowed .

8. The writ petition being W.P.(C) No.3976 of 2022, is restored to its original file with a condition that the defect, if any, is still not removed, the same shall be removed within four weeks, failing which, this order will not be given effect to.
