1. Learned counsel for the petitioner submits that the petitioner is in custody in connection with Chatrochatti P.S. Case No. 18/2026 for the offence registered under Section 103(1), 61(23), 3(5) of BNS, now said to have been pending in the court of learned Judicial Magistrate 1^st Class, Bermo at Tenughat.

Learned counsel for the petitioner submits that the petitioner, aged 65 years, happens to be the step mother-in-law of the deceased and is in custody since 18.04.2026. The petitioner has no role to play and she has been falsely implicated in this case. The eye-witness to the occurrence has got her statement recorded under Section 183 wherein she has made an allegation that her father was assaulting her mother as her father wanted to marry another lady.

Learned counsel for the State has opposed the prayer for bail. However, the aforesaid submissions made by the learned counsel for the petitioner are not in dispute.

To this, learned counsel for the petitioner has submitted that the chargesheet has already been submitted and cognizance has been taken for alleged offence under Section 103(1) and 3(5) of BNS.

After hearing the learned counsel for the parties and considering the statement of the daughter of the deceased recorded under Section 183 of BNSS and also the fact that the charge-sheet has already been submitted, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1^st Class, Bermo at Tenughat in connection with Chatrochatti P.S. Case No. 18/2026, subject to the following conditions: -

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be her close relative.

¶20

(iii) The petitioner will attend the court on each and every date and on account of her single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner would deposit a self-attested copy of her Aadhar Card along with her Mobile Number before the learned court below, which she shall not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned court below.

3. The instant bail application is allowed with the aforesaid conditions.

4. Let a copy of this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through ‘email/FAX’.
