1. Learned counsel for the petitioner submits that the petitioner is in custody in connection with POCSO Case No. 124/2026 arising out of Bagodar P.S. Case No. 70/2024 for the offence registered under Section 366A of IPC, now said to have been pending in the court of learned Special Judge POCSO Act, Giridih.

2. Learned counsel for the petitioner submits that the petitioner is in custody since 13.07.2026 and has been falsely implicated in this case. The prime accused in the present case is one Ajit Kumar, who used to work in the shop of the informant’s father. The charge-sheet has already been submitted and the petitioner has fully co-operated during investigation as is mentioned in the charge-sheet. The co-accused, namely, Ajit Kumar has been granted bail by a co-ordinate Bench of this Court in B.A. No. 8176/2024 vide order dated 29.10.2024 and subsequently another coaccused, namely, Bhawani Mahto @ Bhawani Prasad Mahto has also been granted bail in B.A. No. 10946/2025 vide order dated 05.01.2026. The case of the petitioner is similarly situated as that of the co-accused, namely, Bhawani Mahto @ Bhawani Prasad Mahto.

3. Learned counsel for the opposite party-State has opposed the prayer for bail. However, the aforesaid submissions made by the learned counsel for the petitioner are not in dispute.

After hearing the learned counsel for the parties and considering the statement of the victim recorded under Section 164 of the Cr.P.C. as well as the allegations levelled against the petitioner, this Court finds that the case of the petitioner stands on similar footing as that of the co-accused, namely, Bhawani Mahto @ Bhawani Prasad Mahto, who has been granted bail by this Court in B.A. No. 10946 of 2025. Accordingly, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/(Rs. Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge POCSO Act, Giridih in connection with Bagodar P.S. Case No. 70/2024, subject to the following conditions: -

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative.

¶16

(iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner would deposit a self-attested copy of his Aadhar Card along with his Mobile Number before the learned court below, which he shall not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned court below.

5. The instant bail application is allowed with the aforesaid conditions.

6. Let a copy of this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through ‘email/FAX’.
