The prayer for bail of the petitioner was earlier rejected in B.A. No. 1731/2026.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 04.12.2025. It has further been submitted that 05 witnesses have been examined by the prosecution including the victim and all have been declared hostile by the prosecution. Learned counsel submits that taking into consideration the said fact one of the co-accused Arbind Kumar has been granted bail by a Co-ordinate Bench of this Court in B.A. No. 6874 of 2026.

Learned A.P.P. though has opposed the prayer for bail of the petitioner but has not disputed the aforesaid facts.

Regard being had to the fact that the allegation against the petitioner has been sufficiently diluted on account of the victim as well as the other witnesses of the prosecution having been declared hostile, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Addl. Sessions Judge-cum Special Judge (POCSO), Chatra in connection with Tandwa P.S. Case No. 258/2025, subject to the condition that the petitioner shall remain physically present before the learned trial court on each and every date till the conclusion of trial unless
