2. Learned counsel for the petitioner submits that the petitioner is in custody since 19.06.2026 in connection with Thakurgangti P.S. Case No.20 of 2026, registered under Sections 103 (1) & 3 (5) of the B.N.S. 2023, now pending in the court of learned Judicial Magistrate 1^st Class, Godda.

The learned counsel for the petitioner submits that the petitioner happens to be the cousin sister-in-law of the deceased and during investigation, it was alleged that the petitioner was having illicit relation with the husband of the deceased. She submits that as per the F.I.R., the deceased died due to poison.

4. The FSL report has been produced by the learned counsel for the State, which does not indicate presence of any poison.

5. To this, the learned counsel for the petitioner has submitted that only on suspicion the petitioner has been made accused in the present case. She submits that the petitioner is in custody since 19.06.2026

and charge sheet has been submitted for alleged offence under Sections 108 read with Section 3 (5) of B.N.S., 2023.

6. Learned counsel for the State has opposed the prayer for bail. However, the aforesaid submissions made by the learned counsel for the petitioner is not in dispute.

7. After hearing the learned counsels for the parties and considering the facts and circumstances of this case, it appears that the petitioner has been made accused merely on suspicion. The petitioner happens to be the cousin sister-in-law of the deceased. Further, the FSL report does not indicate presence of any poison and the charge sheet has already been submitted. In view of the aforesaid facts, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1^st Class, Godda in connection with Thakurgangti P.S. Case No.20 of 2026, on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii)The other bailor should be his close relative.

¶23

(iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner will deposit a self-attested copy

of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned trial court.

8. The instant application is allowed with the aforesaid conditions. 9. The learned counsel for the State may take steps for forwarding the FSL report to the concerned court.
