1. Learned counsel for the petitioner submits that the petitioner is in custody in connection with Deoghar Cyber P.S. Case No. 70/2026 for the offence registered under Sections 319(2), 318(4), 338, 336(3), 340(2) of BNS, 66B, 66C, 66D, 84(C) of IT Act, now said to have been pending in the court of learned Additional Sessions Judge-II-cum-Cyber Crime, Special Court at Deoghar.

2. Learned counsel for the petitioner submits that the petitioner is a lady having no criminal antecedent. One Mobile phone and one SIM Card are alleged to have been recovered while she was at home. The petitioner has two children aged three years and five years. The petitioner is in custody since 10.05.2026 and the charge-sheet has been filed on 05.08.2026. The petitioner has been falsely implicated in this case and therefore she may be enlarged on bail.

3. Learned counsel for the State, while opposing the prayer for bail, has submitted that numerous crime links have been found and three victims have also been identified. The mobile and the SIM Card is in the name of other person. However, the other submissions made by the learned counsel for the petitioner are not in dispute.

4. After hearing the learned counsel for the parties and considering the fact that the petitioner is a lady having two minor children, the charge-

sheet has already been submitted and that the petitioner does not have any criminal antecedent, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Cyber Crime, Special Court at Deoghar in connection with Deoghar Cyber P.S. Case No. 70/2026, subject to the following conditions: -

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be her close relative.

¶19

(iii) The petitioner will attend the court on each and every date and on account of her single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner would deposit a self-attested copy of her Aadhar Card along with her Mobile Number before the learned court below, which she shall not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned court below.

5. The instant bail application is allowed with the aforesaid conditions.

6. Let a copy of this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through ‘email/FAX’.
