02/14.09.2026 Heard Mr. D.K. Malityar, learned counsel for the petitioner. None appears on behalf of the State.
The prayer for bail of the petitioner was earlier rejected in B.A. No. 2657 of 2026. Subsequent thereto the petitioner had once again moved for grant of bail in B.A. 4808 of 2026 which however was rejected at that stage vide order dated 02.06.2026.
It has been submitted by the learned counsel for the petitioner that after the rejection of the prayer for bail of the petitioner one witness has been examined by the prosecution who happens to be the Senior Manager, Bank of Baroda and who in his cross-examination has categorically stated that sometimes by mistake amounts are transferred to different accounts and in fact the amount which was transferred to the account of the petitioner has already been returned back to the concerned account. Learned counsel submits that the petitioner is in custody since 10.01.2026.
Regard being had to the evidence of P.W.1 from which it appears that the amount of Rs. 65 lacs which had come in the account of the petitioner has subsequently been transferred back to the original account holder and the period of custody undergone by the petitioner, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with
two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Cyber Cases, Dhanbad in connection with Dhanbad Cyber P.S. Case No. 53/2025, subject to the condition that one of the bailors should be a close relative of the petitioner and that the petitioner shall also appear before the learned trial court on each and every date till the conclusion of the trial, unless prevented by sufficient cause.
