2. Learned counsel for the petitioner submits that the petitioner is in custody in connection with Dhanbad Cyber P.S. Case No. 32 of 2026 for the offences registered under Sections 318(4), 319(2), 338, 340(2), 61(2) of the B.N.S. 2023 and Section 66(C), 66(D) of the Information Technology Act, pending in the court of learned Additional Sessions Judge-II-cum-Spl. Judge, Cyber Crime Cases, Dhanbad.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 08.06.2026 and charge sheet has already been submitted. He has further submitted that as mentioned in the counter affidavit in paragraph 13 there are three complaints of cyber fraud linked with the bank payment application found in the mobile set of the petitioner which are to the extent of Rs. 35,300, Rs. 50,000/- and Rs. 50,000/-. The learned counsel has further submitted that the petitioner is ready to deposit the said amount without prejudice. He has also submitted that the petitioner has one criminal antecedent relating to theft of electricity which is of the year 2023.

Learned counsel for the opposite party-State has opposed the prayer for bail and has submitted that it has come during investigation that six-bank account relating to seized ATM/mobile linked found in the name of the petitioner and 01 account was found in the name of Lakkhi Kant Baourai and there are different bank details which are found in the name of others which are suspicious transactions. He submits that as per the allegation against the petitioner, the petitioner used to persuade the villagers to open the bank account in their names and obtain possession of their ATM Cards, SIM Cards and their mobile numbers by paying

about Rs. 5,000/- each person and thereafter used to send their bank accounts details to those persons who are involved in the commission of cyber offence for a consideration amounting to Rs. 20,000/- to Rs. 25,000/-.

After hearing the learned counsel for the parties and considering the fact that charge sheet has already been submitted and the petitioner has no antecedent of similar nature, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 25,000/(Rs. Twenty-five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Spl. Judge, Cyber Crime Cases, Dhanbad, in connection with Dhanbad Cyber P.S. Case No. 32 of 2026, on the following conditions:

(i) One of the bailors would be the present pairvikar of the petitioner.

(ii) The other bailor should be his close relative.

¶16

(iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner.

(iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

(v) The petitioner shall fully co-operate with the proceedings before the learned court below.

6. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/e-mail.

7. The instant bail application is allowed with the aforesaid conditions.
