02/14.09.2026 Heard Mr. Tarun Kumar No. 1, learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner had earlier moved for grant of bail in B.A. No. 3095 of 2025 which however was dismissed as withdrawn vide order dated 21.04.2025. Subsequent thereto the petitioner had once again moved for grant of bail in B.A. (Filing) No. 5110 of 2026 which was rejected vide order dated 24.03.2026.
It has been submitted by the learned counsel for the petitioner that after the rejection of the prayer for bail of the petitioner charge has been framed and out of eleven charge-sheet witnesses six witnesses have already been examined. Learned counsel for the petitioner has copiously referred to the evidence of the victim who has been examined as P.W.3 and has submitted that only on account of the fact that the petitioner had solemnized a marriage the First Information Report was instituted. It has further been submitted that the informant had willingly acceded to the sexual overtures of the petitioner. It has further been submitted that the petitioner is in custody since 22.01.2025.
In view of the subsequent developments and on consideration of the evidence of P.W.3 as well as the period of custody undergone by the petitioner, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/-
(Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, Ramgarh in connection with Gola P.S. Case No. 11/2025, corresponding to Special POCSO Case No. 14 of 2025, subject to the condition that the petitioner shall remain physically present before the learned trial court on each and every date till the conclusion of the trial, unless prevented by sufficient cause.
