The petitioners are apprehending their arrest in connection with Jamua P.S. Case No. 282 of 2025, registered for the offence under Sections 190, 191(3), 324(4), 109 and 126(2) of Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act, pending in the court of learned Judicial Magistrate, 1st Class, Giridih.

Learned senior counsel appearing for the petitioners submits that the free fight has occurred between two groups of approximately 150 persons each of the group, relating to construction of a building on a particular land. He next submits that there are general and omnibus allegations against all the accused persons and nobody has received any injury. He further submits that in the similar circumstance, seven other co-accused persons have already been provided the privilege of anticipatory bail in A.B.A. No. 622 of 2026 by this court.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of free fight

Considering that approximately 150 persons were involved in both groups in free fight for the dispute relating to construction of a building on a particular land and there are general and omnibus allegations against all the accused persons and there is no injury upon anybody and further in similar circumstance, seven other co-accused persons have already been provided the privilege of anticipatory bail in A.B.A. No. 622 of 2026 by this court, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners, named above, are directed to surrender before the learned court within four weeks from today and in the event of their surrender / arrest, the petitioners, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twentyfive thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih, in connection with Jamua P.S. Case No. 282 of 2025, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
