This civil miscellaneous petition has been filed at the instance of the petitioner for restoration of W.P.(C) No. 6217 of 2016 to its original file.

Learned counsel for the petitioner submits that W.P.(C) No. 6217 of 2016 was dismissed for non-compliance of the peremptory order of this Court dated 27.02.2024 whereby the petitioner was directed to file fresh requisites for service of notice upon the sole respondent. It is next submitted by the learned counsel for the petitioner that information was duly communicated to the concerned department, however due to a miscommunication arising from the transfer of the officer authorized by the petitioner, notice could not be served upon the respondent in compliance of the said

order dated 27.02.2024, resulting in dismissal of the said W.P.(C) No. 6217 of 2016. It is next submitted that the petitioner has very good grounds to agitate in the said W.P.(C) No. 6217 of 2016 and unless W.P.(C) No. 6217 of 2016 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that W.P.(C) No. 6217 of 2016 be restored to its original file.

Considering the aforesaid submission of the learned counsel for the petitioners, W.P.(C) No. 6217 of 2016 is restored to its original file to the stage at which, it was before its dismissal.

List W.P.(C) No. 6217 of 2016 under the appropriate heading after a week before the appropriate Bench.
