The prayer for bail of the petitioner was earlier dismissed as withdrawn in B.A. No.1680 of 2026. Subsequent thereto, the petitioner had once again moved for grant of bail in B.A. No.2680 of 2026 which however was rejected at that stage vide order dated 02.04.2026.

It has been submitted by Mr. Sahani, learned counsel for the petitioner that the petitioner is in custody since 21.11.2025. It has further been submitted that the initial implication of the petitioner was on account of the confessional statement of co-accused Arun Kumar. Learned counsel adds that the petitioner does not have any criminal antecedent and despite charge having been framed, no witness has been examined as yet by the prosecution.

Learned A.P.P. has opposed the prayer for bail of the

petitioner.

Regard being had to the period of custody undergone by the petitioner, the victim having been recovered from inside a car and the fact that there is no possibility of the trial being concluded in near future, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-X, Hazaribagh in connection with Barhi P.S. Case No.328 of 2025, subject to the condition that he shall remain physically present before the

learned trial court on each and every date till the conclusion of the trial unless prevented by sufficient cause.
