Heard learned counsel for the parties.

2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 338, 336 (3), 340(2), 3(5) of BNS.

3. Learned Counsel for the Petitioner submits that the Petitioner is languishing in jail since 26.10.2025. He further submits that the only allegation in the FIR is that the co-accused, along with the petitioner, were proceeding to Palamau to procure opium for the purpose of marketing and nothing has been recovered either from the alleged vehicle or from the conscious possession of the petitioner. He lastly submits that co-accused person has been granted bail in B.A. No.580/26 vide order dated 25.02.2026.

4. Per Contra , learned APP has opposed the prayer for bail.

Considering the fact that the co-accused person have been granted bail, the Petitioner is enlarged on bail by furnishing bail bond of ₹ 20,000/- (INR Twenty Thousand Only) with two sureties of like amount each, to the satisfaction of learned Chief Judicial Magistrate, Palamau in connection with Lesliganj P.S. Case No.154/25.

6. It is made clear that during trial petitioner shall cooperate in trial. Further the petitioner will submit photocopy of his Aadhar Card and mobile number before the court below which he will always keep active and will not change and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
