The petitioners are apprehending their arrest in connection with Latehar Cyber P.S. Case No. 01/2024 registered under Section 318 and 319 Bharatiya Nagrik Suraksha Sanhita, 2023 and under Section 66(C), 66(D) of Information Technology (Amendment) Act, pending in the court of learned Chief Judicial Magistrate, Latehar.

Learned counsel appearing for the petitioners submits that the name of the petitioners have come in the confessional statement and the amount which has been withdrawn from the account of the informant has been transferred to different accounts and that has been withdrawn. He next submits that the petitioners have got no criminal antecedents as disclosed in Para 15 of the petition. He then submits that the case diary has been called for by the Court by the earlier order and the case diary is also silent on the point of criminal antecedents.

Considering that the amount of the informant has gone in different accounts and thereafter the amount has been withdrawn, it is not clear that the amount has been withdrawn by the petitioners or not and the name of the petitioners have come on the confessional statement, the case diary is silent on the point of the criminal antecedents and in Para 15 of the petition, it is disclosed that the petitioners have got no criminal antecedents, in that view of the matter, the petitioners above named are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and condition and sureties, as the learned Court may deem fit and proper.
