02 /05.02.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Dumri P.S. Case No.130 of 2024, for the alleged offences registered under Sections 126(2), 115, 3(5), 82 & 85 of the Bharatiya Nyaya Sanhita, 2023 and Section 3 & 4 of the D.P. Act, pending in the Court of learned J.M., 1^st Class, Giridih.

Learned counsel appearing for the petitioner submits that the petitioner happens to be the husband of the informant and informant has lodged three cases against the petitioner, wherein, the petitioner has been acquitted in G.R. Case No. 85 of 2014 and another case is pending for the trial against him. He submits that the false allegation is made of torture and demand of dowry.

4. Learned counsel appearing for the State opposes the prayer and submits that the petitioner happens to be the husband of the informant.

Considering that the petitioner happens to be the husband and three cases have been lodged against the petitioner by the wife, and in one of the case, the petitioner has already been acquitted and another case is pending at the stage of trial. In that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
