The prayer for bail of the petitioner was earlier rejected in B.A. No.1966 of 2026.
Submission has been advanced by the learned counsel for the petitioner that the FSL report reveals that 2.641 kg. of opium was found and not 4.72 kg. of semi liquid opium which was initially said to have been recovered from the vehicle. Learned counsel while referring to the seizure list has submitted that the opium was found in a bag and if the weight of the same is taken into consideration, the quantity of opium will be less than the commercial quantity. Learned counsel submits that the petitioner is in custody since 12.11.2025.
Learned Spl.P.P has opposed the prayer for bail of
the petitioner.
Regard being had to the aforesaid facts, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III-cum-Special Judge, NDPS, Chatra in connection with Pathalgadda P.S. Case No.54 of 2025.
This application stands disposed of.
