2. Learned counsel for the petitioner submits that the petitioner is in custody in connection with Muffasil P.S. Case No. 57 of 2026, S.T. Case No. 290 of 2026, for the offences registered under Sections 69, 115(2), 351(3) & 352 of the B.N.S. 2023, pending in the court of learned Additional Sessions Judge-VI, Hazaribagh.

Learned counsel for the petitioner submits that on the face of the FIR itself the petitioner and the victim were living together for the last two years and the FIR was lodged only when the petitioner alleged to have refused to marry with the victim. The learned counsel submits that the petitioner is in custody since 05.04.2026 and charge has been framed on 17.06.2026 and no witness has been examined so far. The learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

4. Learned counsel for the opposite party-State has opposed the prayer for bail and has submitted that he is not aware as to whether the petitioner has criminal antecedent or not, however, the other submissions made by the counsel for the petitioner is not in dispute.

After hearing the learned counsel for the parties and considering the fact that the petitioner is aged 23 years and the victim was also major and both were living together for the last two years as per the FIR itself and charge has also been framed and the petitioner has no criminal antecedent, the petitioner above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Hazaribagh, in

connection with Muffasil P.S. Case No. 57 of 2026, S.T. Case No. 290 of 2026, on the following conditions:

(i) The learned court shall call for the criminal antecedent report of the petitioner and if any antecedent is found, the petitioner may not be released on bail.

(ii) One of the bailors would be the present pairvikar of the petitioner.

(iii) The other bailor should be his close relative.

(iv) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner.

(v) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.

(vi) The petitioner shall fully co-operate with the proceedings before the learned court below.

6. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/email.

7. The instant bail application is allowed with the aforesaid conditions.
