The petitioner has been made accused in connection with Jariyagarh P.S. case no. 21 of 2023 instituted under Section 279, 337, 338 of the IPC read with Section 134, 184, 187 of the M.V. Act and also under sections 20(b)(ii)(c) of the N.D.P.S. Act.

Learned counsel appearing for the petitioner submits that this is the fourth journey of the petitioner with the prayer for regular bail as his earlier bail application was rejected thrice. It is next submitted that the allegation against the petitioner is that the petitioner was transporting 106.76 kg of cannabis and was apprehended by police while escaping from the vehicle as the police stopped the vehicle by blocking the road. It is next submitted that the only fresh ground is that in the meanwhile, PW 7 and 8, have been examined who have supported the case of prosecution. It is next submitted that the petitioner has been in jail custody since 30.05.2023, as mentioned in para 1 of this bail application. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to co-operate with

the trial of the case hence, the petitioner be admitted to regular bail.

Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that since the prayer for bail of the petitioner has already been rejected thrice and as the seized Ganja comes under commercial quantity; in the absence of any material to suggest that the petitioner is not guilty of the allegations and that there is no chance of him being not involved in any offence while on bail, the petitioner ought not be released on bail. It is next submitted that, there is every chance of the petitioner absconding if released on bail. It is lastly submitted that the prayer of the petitioner for bail, be rejected.

Considering the serious nature of allegation against the petitioner of being involved in transportation of Ganja in commercial quantity and in the absence of any material to suggest that the petitioner is not guilty of the allegations and that there is no chance of him being not involved in any offence while on bail as well as the chance of his tampering with the evidence and absconding, if released on bail, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected at this stage.
