05/ 15.09.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Azad Nagar P.S. Case No. 39 of 2026, registered for the offence under Sections 191(2), 191(3), 126(2), 115(2), 118(1), 109, 352, 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Jamshedpur.

Learned counsel appearing for the petitioner submits that the altercation took place between both the sides and both the sides are friends and at the spur of the moment, the altercation took place and further there are case and counter case between them. He next submits that there are general and omnibus allegations. He further submits that the petitioner side has also received the injury and has lodged a case being Azad Nagar P.S. Case No. 38 of 2026. He next submits that two of the co-accused persons, in the case filed by the petitioner side has already been provided the privilege of anticipatory bail by this court in A.B.A. No. 4919 of 2026. He also submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-12 of the petition. He then submits that one of the other coaccused in the present case has already been provided the privilege of anticipatory bail by this court in A.B.A. No. 4998 of 2026. On these

grounds, he submits that anticipatory bail may kindly be provided to the petitioner.

Learned A.P.P. has opposed the prayer and submits that the allegations are there of making assault and further the injuries are grievous in nature. On these grounds, he submits that anticipatory bail may kindly be rejected.

Considering that there are case and counter case between the parties and at the spur of the moment, the altercation took place between both the sides and both the sides are friends and both the sides have received injuries and two of the co-accused persons, in the case filed by the petitioner side has already been provided the privilege of anticipatory bail by this court in A.B.A. No. 4919 of 2026 and further one of the co-accused in the present case has also been provided the privilege of anticipatory bail by this court in A.B.A. No. 4998 of 2026 and the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-12 of the petition and in the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within four weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Jamshedpur, in connection with Azad Nagar P.S. Case No. 39 of 2026, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
