2. The petitioners are apprehending their arrest in connection with Jamua P.S. Case No. 133 of 2026, for the offence registered under Sections 126(2), 115(2), 127(2), 117(2), 118(1), 118(2), 109, 303(2), 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate 1^st Class, Giridih.

Learned counsel appearing for the petitioners submits that during the pendency of this anticipatory bail application petitioner No.1 namely Kishori Choudhry has already been arrested and in view of that he is not pressing the petition in respect of petitioner No.1, namely, Kishori Choudhry. He submits that now this petition is surviving only for petitioner No.2.

4. Learned counsel appearing for the State has got no objection.

5. In view of his such submission, the anticipatory bail of petitioner No.1, namely, Kishori Choudhry, is dismissed as not pressed.

6. Learned counsel appearing for the petitioners submits that so far petitioner No.2 is concerned there are general and omnibus allegation and main allegation is there against Kishori Choudhry. He further submits that due to land dispute the altercation took place. He then submits that there are case and counter case and both are agnates.

7. Learned counsel appearing for the State opposes the prayer and submits that allegations are there of assault.

8. On perusal of the FIR, it transpires that allegation of assault is there against Kishori Choudhry and he has already been arrested and there are general and omnibus allegation and there are case and counter case and both the sides are agnates. In the attending

facts and circumstances of this case, I am inclined to provide privilege of anticipatory bail to the petitioner No.2, namely, Pramod Choudhry.

Accordingly, the petitioner No.2, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner No.2, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1^st Class, Giridih in connection with Jamua P.S. Case No. 133 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
