02 /15.09.2026 Heard learned counsel appearing for the petitioner as well as learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Dhurwa (Tupudana) P.S. Case No.125 of 2021, for the alleged offences registered under Sections 414 of Indian Penal Code, Section 4/21 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004 and under Rule 7, 9 and 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned Chief Judicial Magistrate, Ranchi.

3. Learned counsel appearing for the petitioner submits that the petitioner has been implicated in this case only on suspicion and false allegations are made of storing of sand. She further submits that the petitioner has nothing to do with the said storage and the petitioner has got no criminal antecedent as disclosed in paragraph No.12 of the petition. She then submits that two of the co-accused persons have

already been granted anticipatory bail in A.B.A. Nos.4565 of 2022 and 2059 of 2026. On these grounds, she submits that anticipatory bail may kindly be granted.

4. Learned counsel appearing for the State opposes the prayer and submits that allegations are there of storing 500 cft. sand and in view of that anticipatory bail may kindly be rejected.

Considering that the name of the petitioner has come only on the basis of suspicion and the petitioner has got no criminal antecedent as disclosed in paragraph No.12 of the petition and further two of the coaccused persons have already been granted anticipatory bail in the aforesaid A.B.As., I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Ranchi in connection with Dhurwa (Tupudana) P.S. Case No.125 of 2021, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
