06/ 14.09.2026 Heard learned counsel for the petitioners and learned A.P.P for the State.

The petitioners are apprehending their arrest in connection with Rajrappa P.S. Case No.78 of 2026, registered for the offence under Sections 115(2), 126(2), 118(2), 109(1), 303(2), 317(5), 352, 351(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Ramgarh.

Learned counsel appearing for the petitioners submits that false allegation is made of trying to steal the diesel from the godown of the CCL and the allegations are made of scuffle with the security personnel. He submits that even the allegations are made of assault by sword, however, the injury is found to be simple and that has come in the order of the learned Sessions Judge. He further submits that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-16 of the petition. He next submits that allegation is there against 18 to 20 persons and several co co-accused has been granted anticipatory bail in A.B.A. No. 4850 of 2026 and A.B.A. No. 4873 of 2026 by this court. On these grounds, he submits

that anticipatory bail may kindly be provided to the petitioners.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of forcefully entering and trying to steal the diesel from the godown of the CCL. On these grounds, he submits that prayer for anticipatory bail may kindly be rejected.

On perusal of the FIR, it transpires that the allegations are there of attempt to steal the diesel and the allegation is there against 18 to 20 persons and in the order of the learned Sessions Judge, it has come that the injury is found be simple wherein the allegation is made of assault even by sword and several other co-accused has been granted anticipatory bail in the aforesaid A.B.As, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioners.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners, above named.

Accordingly, the above-named petitioners are directed to surrender before the learned court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand)each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Ramgarh, in connection with Rajrappa P.S. Case No.78 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
