05/ 14.09.2026 Heard learned counsel for the petitioners and learned A.P.P for the State.

The petitioners are apprehending their arrest in connection with Hazaribagh Sadar P.S. Case No. 137 of 2026, registered for the offence under Sections 126(2), 115(2), 352, 351(2), 351(3), 76, 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned CJM, Hazaribagh.

Learned counsel appearing for the petitioners submits that false allegations are made against the petitioners and the informant and petitioners’ side are neighbours. He next submits that there are case and counter case between the parties and both the sides have alleged almost similar facts. He further submits that earlier also, the altercation took place, however, later on settlement was made by way of Annexure-4 of

the petition. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioners.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of making assault. On this ground, he submits that anticipatory bail may kindly be rejected.

On perusal of both the FIRs, it transpires that in both the FIRs, almost similar allegations are there and altercation took place when both the sides were cleaning the front of their houses and further the alleged occurrence is said to be dated 17.05.2026, wherein the FIR has been lodged on 28.05.2026.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners, above named.

Accordingly, the petitioners, named above, are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned CJM, Hazaribagh, in connection with Hazaribagh Sadar P.S. Case No. 137 of 2026, subject to conditions as laid down under Section 482 (2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
