2. The petitioner is apprehending his arrest in connection with Taratand P.S. Case No.07 of 2024, for the alleged offences registered under Section 392 of Indian Penal Code pending in the Court of learned Judicial Magistrate First Class, Giridih.

3. Learned counsel appearing for the petitioner submits that the petitioner is aged about 23 years and he is aspirant of competitive examinations. He further submits that father of the petitioner is having criminal antecedent and the petitioner has nothing to do with the said case. He then submits that the petitioner is not named in the FIR and name of the petitioner has been taken by one Imran @ Nepali, who has enmity with the father of the petitioner. criminal antecedent as disclosed in paragraph No.11 of the petition. On these grounds, he submits that anticipatory bail may kindly be granted.

4. Learned counsel appearing for the State opposed the prayer and submits that the name of the petitioner has come on the confessional statement of Imran @ Nepali.

Considering that the petitioner is not named in the FIR and the criminal antecedent is there of father of the petitioner and Imran @ Nepali has taken the name of the petitioner and the said Imran @ Nepali is having the enmity with the father of the petitioner and the petitioner is said to be aspirant of competitive examinations, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate First Class, Giridih in connection with Taratand P.S. Case No.07 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
