2. The petitioner is apprehending his arrest in connection with Nirsa P.S. Case No.92 of 2026, for the alleged offences registered under Sections 191(2), 191(3), 190, 115(2), 117(2), 126(2), 109 and 308(4) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1^st Class, Dhanbad.

Learned counsel appearing for the petitioner submits that the petitioner and informant are known to each other and the alleged occurrence is said to be dated 06.03.2026 wherein the FIR has been lodged on 09.03.2026. He further submits that although in the FIR the allegations are there of assault, however, in the order of learned Sessions Judge it has come that injury of lacerated wound over frontal region and abrasion on his left forearm and left elbow. FIR which suggests that the said injury was not of altercation between the petitioner and informant and the petitioner has been falsely implicated in this case. On these grounds, he submits that anticipatory bail may kindly be granted.

4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of assault and the injury has been received.

Considering that the date of occurrence is said to be dated 06.03.2026 wherein the FIR has been lodged on 09.03.2026 and it has been pointed out that the petitioner and informant are known to each other and the petitioner has been falsely implicated in this case and in view of that belatedly the FIR has been lodged, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1^st Class, Dhanbad in connection with Nirsa P.S. Case No.92 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
