02 /14.09.2026 Heard learned counsel appearing for the petitioner as well as learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with Baliapur P.S. Case No.101 of 2026, for the alleged offences registered under Sections 274, 275, 292 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 47(a) of Excise Act pending in the Court of learned Judicial Magistrate 1^st Class, Dhanbad.

Learned counsel appearing for the petitioner submits that in the FIR itself it has been alleged that only one beer bottle and two bottles of vodka of 180 ML was seized and the said wine was kept by another staff of the shop and the said wine was not for sale. He further submits that the petitioner is employee of shop of Manit Chanjar. He then submits that no foreign liquor was recovered from the shop of licensee. On these grounds, he submits that anticipatory

4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of keeping one beer bottle and two bottles of 180 ML of vodka.

5. Considering the quantity of alleged seizure of liquor which is very less and the petitioner is said to be employee of shop of Manit Chanjar and from the shop of said Chanjar foreign liquor has not been seized, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1^st Class, Dhanbad in connection with Baliapur P.S. Case No.101 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
